Below are the terms and conditions that apply to all services provided by Enviro Heating Services Ltd. Please read them carefully to understand your rights and obligations. “The company” refers to Enviro Heating Services Ltd, including its authorized employees and agents.
“The customer” refers to the individual to whom the quotation is addressed, their principal or agent, property owner, and occupier.
These Terms and Conditions, along with the provided quotation, form the entire contract between the company and the customer. Any amendments must be signed by an authorized officer of the company. The customer warrants that no other representations or verbal agreements will be considered valid under this contract.
This agreement becomes binding if: a) The quotation is accepted within one month of the date. b) The customer confirms acceptance of proposed works or appointments via email, phone, or letter. c) The customer passes the company’s credit check. d) The customer subscribes to the Enviro Heating Service Plan.
If the customer fails to accept the quotation within one month or if delays occur beyond the company’s control, the company is entitled to additional costs for materials, labor, and expenses.
All design details and drawings remain the property of the company and are protected by copyright.
If the customer breaches the contract or cancels it, the company is entitled to: a) Costs incurred for preparation and design. b) Costs of delivered materials and equipment. c) Costs of completed work and labor. d) Liquidated damages for loss of profit.
The company will clear away all disconnected materials and packaging from the customer’s premises, excluding items like oil storage tanks and restricted-access equipment.
The company is not liable for delays in commencement or completion of works and any given dates are approximate. Payment timelines are binding.
The customer warrants compliance with all relevant laws, regulations, and consents required for the contract works.
The customer is responsible for ensuring compliance with Building Regulations and the latest IEE Wiring Regulations, including additional works not contracted to the company.
The customer must ensure a minimum mains water pressure of 2 Bar for proper installation. The customer will cover costs for any necessary water boosting systems or pressure regulation devices.
Materials and equipment on the customer’s premises are the customer’s responsibility. Any damage or loss will be paid for by the customer.
The customer is responsible for all fire-related losses and must indemnify the company against such losses.
Materials and equipment remain the property of the company until full payment is made. The company can recover its property in case of non-payment.
The company is not liable for weather-related damage to works or the customer’s premises.
The quotation assumes: a) No interruptions or delays caused by the customer or third parties. Delays will result in immediate payment of the contract balance. b) The existing system is in good working order. No warranty is given for the existing system. c) The customer arranges for chimney sweeping and clears any obstructions. d) Safe access for installation is provided. Costs for special access are chargeable. e) The customer removes floor coverings before installation. f) The customer handles asbestos-related works separately. g) The company is not responsible for existing leaking or defective pipework. h) The company is not responsible for existing structural defects.
The company will make good holes to a plaster finish only. The customer is responsible for other repairs and decorations.
The company will lift and relay softwood floorboards. The customer arranges for renewal of other types of flooring.
The customer clears loft space for insulation or other works.
The customer agrees on the location of equipment in advance. Any alterations are at the customer’s expense.
Temperature conditions assume steady-state conditions with specific outside temperatures and air changes per hour.
The customer provides chases and ducts for floor screed pipework and complies with all regulations.
The company is not liable for damage caused by removal of existing pipework or equipment.
The company maintains public liability insurance for accidental damage.
The company’s liability for loss or damage is limited to the contract price excluding VAT.
The company guarantees workmanship for two years, contingent on full payment. The customer must service appliances as per manufacturer’s instructions.
Service Plan members confirm understanding of the Service Plan Brochure.
TERMS OF PAYMENT
25% of the contract price is payable with the order. The balance, including any additions, is due upon installation completion. Non-compliance incurs 1.5% monthly interest on outstanding sums. Remedial work post-completion is free under guarantee, subject to payment.
Signing the “Acceptance document” waives the right to cancel within 14 days of the quotation date. Finance package acceptance requires a 14-day cooling-off period post-signature.
EXTENDED WARRANTY
Natural Gas Boilers installed by Enviro Heating Services Ltd are guaranteed against faults as per the manufacturer’s guarantee. Extended warranties require annual servicing by Enviro Heating Services Ltd, replicating manufacturer terms once the initial guarantee expires.
